Bandar Seri Begawan – Twenty-Four Syar’ie lawyers recently received their certificates of accreditation from Pehin Siraja Khatib Dato Paduka Seri Setia Ustaz Hj Awg Yahya bin Hj Ibrahim, the Head Syar’ie Judge.
The recipients are now officially accredited as Syar’ie lawyers under the Syariah Courts Act, Section 184, Syariah Courts Procedure (Syar’ie Lawyer) 2002.
According to Pehin Ustaz Hj Awg Yahya, Syar’ie lawyers must not only have vast knowledge in law and Syariah court procedures, but also knowledgeable on Islamic law, as they are the ones who will analyse the facts according to quotations from al-Quran and Syara’.
Without having a Syar’ie lawyer in court, it may delay court proceedings, as there are a lot of regulations and terms related to Syara law, he said.
About 2,010 cases were referred to the Syariah court in 2008. Out of this number, only 73 parties (roughly 3.7 per cent) appointed Syar’ie lawyers. — Courtesy of Borneo Bulletin
