AT THE Magistrate Court yesterday, a local man pleaded not guilty to impersonating a police officer in order to obtain a mobile phone from a 23-year-old man, while his brother, the alleged accomplice, also pleaded not guilty to abbeting the crime.
Ramlee Ahmad, 42, faces two charges of impersonating a public servant and dishonestly obtaining property, which carries a maximum penalty of seven years with a fine under Section 170 and Section 420 of the Penal Code (Chapter 22).
His brother, Jainuddin Ahmad, was also charged with abetting the alleged offence and faces seven years jail time under Section 109 and 420 of the Penal Code.
The incident is said to have taken place on March 12 near the Bumiputera Commercial Trade Centre in the capital, when Ramlee allegedly introduced himself to the complainant as a police officer and asked him to hand over his Nokia mobile phone for examination.
The prosecution stated that they plan to call 10 witnesses to give evidence in court while the defendants, who are unrepresented, will call five witnesses.
Ramlee and Jainuddin were released on court bail of $2,000 or two local sureties.
The conditions of their bail state that the two brothers must report to the Bandar Seri Begawan Police Station every Wednesday and they must not contact the complainant or prosecution witnesses.
Their trial is set to begin in September 7, 2010.
