An Indonesian woman will serve time in jail for residing in the Sultanate under an expired visit pass – an offence under section 15(1) of the Immigration Act, Chapter 17, which is punishable under Section 15(2)(b) and Section 55(3A).
Santi will spend a total of five months behind bars and in-lieu of whipping, she was fined $800, which went unpaid.
Immigration personnel from the Enforcement Section discovered the 35-year-old on June 23, 2010 after receiving a complaint.
The team carried out an inspection at a stall where she was working that was located in the vicinity of Serasa Beach. She failed to produce any valid travel documents.
According to the Immigration Department database, the defendant last entered Brunei on June 25, 2009 through Kuala Lurah Immigration Control Post and was granted a Social Visit pass that was valid only until July 9 , 2009, making her stay in Brunei 349 days overdue.
She had also admitted in her statement that she had lost her passport sometime in April 2010, which went unreported to relevant authorities until her arrest.
